ACCEPTABLE USE POLICY
Subseven.Com.My Acceptable Use Policy addresses some of the specific
requirements that apply to Customer's use of the Internet. Subseven.Com.My
has no obligation to control, monitor, verify, warrant, approve, edit,
censor, review, or take any responsibility for the information that
Customers may acquire, transmit or store through the Internet. Accordingly,
Subseven.Com.My is not responsible for injury that results from inaccurate,
unsuitable, offensive or illegal Internet communications. Customers are
responsible for compliance with all laws and regulations, as well as the
applicable policies of Subseven.Com.My s Internet and network providers. If,
however, Subseven.Com.My becomes aware of any violation of law or this
Acceptable Use Policy by or through a Customer, Subseven.Com.My shall have
the right, but not the obligation, without liability to Customer, to take
any action to remedy such violation. Such actions may include, without
limitation, removal of the information at issue, blocking of offending
transmissions, suspension or termination of a Customer's Services with
Subseven.Com.My , and any other remedy available to Subseven.Com.My by
contract or law.
ILLEGAL OR IMPROPER USE
The customer agrees to use the Subseven.Com.My s network for lawful purposes
only. Customer shall not use the Subseven.Com.My s Network in connection
with any (A) infringement or misappropriation of any copyright, trademark,
trade secret or other intellectual property rights; or (B) defamation,
libel, slander, obscenity, or violation of the rights of privacy or
publicity; or any other offensive, harassing or illegal conduct.
SYSTEM AND NETWORK SECURITY
Subseven.Com.My strictly prohibits the use of the Subseven.Com.My network to
violate the security of any system or network, including, without
limitation, unauthorized access (often known as "hacking") to, monitoring
of, probing, or interference with, computers or networks and distribution of
viruses, or interfering with services, such as through denial of service
attacks, and other destructive activities. Customer may not through action
or inaction permit others to use its network for illegal or inappropriate
actions, or to violate the terms of this AUP.
ABUSIVE EMAIL TACTICS /SPAMMING
Customers may not engage in abusive email tactics or send unsolicited bulk
email, a process commonly known as spamming, which shall include, but not be
limited to, the following types of conduct:
(a) Transmitting data in any manner that violates a State or Federal law,
rule or regulation against spamming or other prohibited communications,
regardless of how such law defines spamming or other such prohibited
activity.
(b) Posting a single article or substantially similar articles to an
excessive number of newsgroups, or continued posting of articles that are
off-topic (e.g., off-topic according to the newsgroup charter, or the
article provokes complaints from the regular readers of the newsgroup for
being off-topic).
(c) Sending unsolicited email messages that provoke complaints from the
recipients, which threaten harm to person or property, or which result in
harassment of the recipient.
(d) Sending unsolicited email messages including, without limitation,
commercial advertising, informational announcements, chain letters, or other
solicitations.
(e) Use of resources not belonging to the customer, without the express
permission of the resource owner, to relay email or other internet traffic.
(f) Falsifying or forging email or newsgroup header information.
COOPERATION WITH SUBSEVEN TECHNOLOGY AND
AUTHORITIES
Subseven.Com.My will cooperate with law enforcement and other authorities in
investigating claims of illegal activity or suspected illegal activity. In
addition, Customer shall cooperate with Subseven.Com.My in any corrective
action that Subseven.Com.My deems necessary to correct and prevent
impermissible use of Subseven.Com.My's network by any of Customer's end
users, including without limitation, providing Subseven.Com.My with all
information necessary to investigate the suspected violation. In addition,
Subseven.Com.My may disclose information transmitted over its facilities
where necessary to protect Subseven.Com.My and its customers from harm, or
where such disclosure is necessary to the proper operation of
Subseven.Com.My's network.
LIMITATIONS OF LIABILITY
IN NO EVENT SHALL Subseven.com.my BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF THE Subseven.com.my SITE OR ANY Subseven.com.my SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER. IN NO EVENT SHALL Subseven.com.my'S CUMULATIVE LIABILITY EXCEED AN AMOUNT GREATER THAT THE CLIENTS ASSOCIATED HOSTING FEE (LESS SET-UP FEES, DOMAIN REGISTRATION, AND OVERAGES).
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Subseven.com.my from any and all liabilities, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action and/or claims caused by or resulting indirectly from your use our services.
CANCELLATION
Subseven.com.my reserves the right to cancel the account at any time.
Customers may cancel at any time. Money back guarantee only applicable to
those products and services that specified with this offer. Any other
products or services with no specification in money back guarantee are not
entitling to any money back or refund. Under the money back guarantee, only
first-time accounts are
eligible for a refund. For example, if you've had an account with us before,
cancelled and signed up again, you will not be eligible for a refund. This
is to protect our refund guarantee from being abused. Subseven.com.my
reserved the right to determine the definition of first-time account.
DOWNTIME
Is defined as any Subseven.com.my scheduled interruption of Services, for the purpose of network upgrades, or replacement of any equipment in order to provide for you better service. Scheduled downtime occurs during notified downtime periods. Subseven.com.my is also not responsible for data center outages.
DISCLAIMER OF WARRANTY
THE SERVICES, THE Subseven.com.my SITE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE Subseven.com.my SITE, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. Subseven.com.my DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, Subseven.com.my SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.
ILLEGAL FILES / PHISHERS
Please note that Subseven.com.my does not allow illegal files on our servers such as phishers and more. If these files are found by us on our servers they will be deleted and account suspended. If you are from the government please note that we take no responsibility for our clients and their actions.
